EPB and my first Land Rover

Bought a very good D3 XS manual with 30k on the clock on 8th Mar with 2 month LR warranty left. 6 days later yellow warning light, EPB no auto release, but park brake works on/off. Back into Knutsford dealer who resets system and clears fault light. 2 days later, same fault light. Return to dealer today.

EPB system checked, no fault found today - suspected clutch slipping, but can only prove this by inspecting clutch which means 6 hours labour @ £100/hr ouch! No here's the dilemma.... if fault can be found when clutch stripped then LR will pay under warranty, but if no obvious fault and clutch very worn, LR will play the fair wear and tear card and I will be left with a £800-900 bill which seems very unfair after 10 days ownership and less than 200 miles. I know the previous owner and do not suspect that the clutch is actually worn out, so a fault is most likely, but it is risky.

Does anybody have any experience of this sort of situation and likely outcomes. Any advice on how to play this with LR, dealer and previous owner is much appreciated. I will have to tell the dealer to press on and strip the clutch but with a great deal of concern.

The XY switch (gear position switch) loses its calibration if the clutch slips. Slipping can be caused by a worn flywheel or clutch. However, land Rover have issued Special Service Message stating that customers are resting their foot on the clutch pedal causing the clutch to slip!

I'm sure a resolution can be found, but I would maybe begin to discuss:

CONDITIONAL VEHICLE EXCHANGE POLICY
You can be confident that all Approved vehicles meet the strictest quality standards. However, if the dealer is unable to resolve to your satisfaction a demonstrable fault, within the first 30 days or 1,000 miles (whichever is sooner), you will be entitled to exchange your vehicle for a similar vehicle of equal or higher value.

Which comes as a result of their full inspection before you purchased ......

Edit - WTF has the Clutch got to do with the EPB. The EPB has a seperate clutch, but it sure has hell doesn't take six hours to strip.....

The park brake won't release if the Gbox doesn't know what gear it's in.
You should also find that reverse lights and PDC doesn't work, also the gear indicator on the dash.
People assume the worst when they get a 'park brake fault' message displayed.

And 6 hours for a clutch is reasonable.

Totally agree - if you have bought a 2nd hand car from a LR dealer (or any dealer for that matter) then in simple terms

It has to be FIT FOR PURPOSE, and assuming you were not told it had ANY faults that would not be fixed, then ANY costs will be at the dealer (sellers) expense, especially if you notify then of the fault(s) during the warranty period.

If you get no joy after asking nicely (getting angry usually get you nowhere) be persistent, don't take 'no' as an answer, then politely 'threaten' that you be contacting the trading standards agency, and also possibly seeking legal advice, this will nearly always be more than enough to ensure it is sorted at no cost to you.

Although buying a car is in some ways different to buying a TV or a Toaster, as far as the 'goods' being 'fit for purpose and of mechantable quality' there is no difference

Also, another avenue you can consider, is if you have bought on finance, consider recourse with whoever it is funded by - this also can be very effective, especially if you threaten to withold payment until it is fixed Unless it is a personal bank loan then that one won't wear)

06 D3 now gone to family member and still going strong at 265k

Thanks guys. I bought the car privately from a friend and work colleague, so limited recourse here. The reversing lights and parking sensors do not work, but the gearbox does know what gear it is in, although it does take 1-2 seconds to register on the dash. Park brake applies and releases perfectly well manually, so car is usable.

If it's still under normal LR warranty then it should not cost you anything for them to investigate and cure the evident fault you have.
