Restricted Performance

Hello all,
my first post here, trying to help my brother with his D4 HSE TDV6 MY2010 intermittent Restricted Performance issue. I have searched left and right on this forum, lot of helpful advice, tried to check most of the suggestions.

no restriction in actual performance
it happens more often during cold ambient temperatures (started again as the weather is getting cold now)
it does not happen during cold start (first start of the day or after more than 1 hour stop)
it happens during warm start only, not during driving
no faults for engine (on cheap OBD diag tool)
car has 250k kilometers, regular service

one intake manifold was cracked and replaced
fuel filter housing replaced
MAF

I would like to ask you for help investigate 'warm start only' and 'cold ambient temperature' conditions - would there be a sensor or vacuum issue presenting itself in these conditions only?

Is this 'Restricted Performance' error connected with engine ECU only, or it is general car performance? In other words, could this error be coming from another subsystem or engine only?

Cant answer, but this sounds like my issue... but i am getting a water in fuel when i check the codes, I haven't done the fuel filter housing yet but will be doing this over Christmas.

Following for more suggestions if this doesn't fix mine
