As you are part exchanging, read through the paperwork that you sign at point of sale. While you not have to volunteer this information in a private sale, the dealer may have covered themselves for this in the T's&C's of their paperwork that you sign during the PX.
I'd suggest that you ask for a complete copy of the documents that you'll be signing to be provided, for you to read through, before the day that you need to sign them 2011 - 2015: 3 x FL2

I'm guessing it's likely an older D3 you're selling? Really can't see a dealer being that bothered as more than a good chance it'll be off to the auction house or moved on within the trade unless they are a budget sales type outfit?

Theoretically is a car with the egrs removed not legally roadworthy?
Steve You remind me of a younger me, not much younger mind...perhaps even a little older!

I really wouldn’t worry about it. Plead ignorance, the car was like it when I got it.
The guy who sorts my car out told me mine had been blanked, I had google it to find out what they did.

Steve
“Although it is not illegal to remove the EGR from your vehicle, it is an offence under the Road vehicles (Construction and Use) Regulations (Regulation 61a(3))1 to use a vehicle which has been modified in such a way that it no longer complies with the air pollutant emissions standards it was designed to meet. Removal of the EGR will almost invariably contravene these requirements.
The potential penalties for failing to comply with Regulation 61a are fines of up to £1,000 for a car or £2,500 for a light goods vehicle.” 2011 - 2015: 3 x FL2

Hi
Reading Red Merles reply
Not illegal to remove egr valve , so no law broken
It's an offence to use a vehicle which has been modified in such a way that it no longer complies with the air pollutant emissions standards , It has passed last two MOT checks so would seem there are no problems

It remains illegal, it's just that you've not been caught out yet.
Having a wife with asthma, which is severely aggravated by air pollutants such as NOx and watched her fight for every breath during a bad attack, I have fairly strong feelings when people disable their emissions control systems and not only help to hurt my wife, but increase the levels of NOx in city centres to the point where all all diesels, even those whose systems haven't been deliberately disabled, are being banned and / or charged. 2011 - 2015: 3 x FL2
