Whats he doing (the moving vehicle not the stopped one ) Its a clear day very light traffic and nothing obstructing his view of a car that has broken down in lane 3. The dash cam car manages to see it and he is behind Mr blind man !The happiest of people don't necessarily have the best of everything;

Should either of them be hogging the3rd lane anyway? Not sure how the layout ahead with the joining motorway works so can;t comment too much on it.
Like you said, disco driver spots it, they didn't even brake until impact. So I would stick my neck on the line and say their eyes were not on the road...

I wonder what the breakdown was. Unusual that you don't have some time/speed to get across to the hard shoulder.
Black car didn't see the stopped car at all - no brake lights until a metre or two before impact. That'll be a charge of driving without due care and attention, then.

That’s our junction as I only live half a mile away. It’s a 50mph zone as well. Just up ahead is the end of the motorway (junction 4. Would you believe they never got planning permission for J3, J2 or J1) and you can go one of three ways so not that unusual for people to be in the 3rd lane. There is a speed camera as well that apparently has made a fortune in fines.D4 MY15 SE TECH

If that Disco had seen the broken down vehicle (as he says he did), he should've anticipated what could've happened and (safely) moved into lane 1 (why still stay in lane 3?), allowing the black car to move into lane 2 at the point he noted there was a broken down vehicle.
Unfortunately the black car didn't notice the broken down vehicle in time, but had he, he would've been able to avoid it by moving into lane 2.

^ Looks like the disco did try to move but the bentley doing the undertake in lane 2 maybe coming at speed prevented him?
