there is always the possibilith that the auction site got the mileage wrong.

I would start at the auction site just to make absolute certain the mileage advertised was correct !.

What do the MOTs say the mileage was.

He was actually within his rights to refuse to refund. Private sellers are not assumed to be experts, so it is sold as seen and even if the engine falls out 1 mile down the road, there is no legal comeback...unless you can PROVE the seller KNOWINGLY described the car incorrectly. But that's very hard, because they only have to say they didn't know. That is AA legal advice btw as something similar happened to me. Thumbs Up

So chap, was the seller of this Discovery a business or a private individual? You are much more likely to get a refund from the former rather than the latter.

I would argue he is a trader
he claimed to sell caravans for a living on ebay however he was a new user so i suspet he closed and reopened accounts
he had a Range rover for sale at the time and also a old disco
he bought the Disco as we all know a few weeks earlier and cleaned it up and sold it on

i would have thought this would be all prrof he was a trader

i think he is clever though and certainly quoted the law at me

i will still have a go at him as it will cost him money ect to defend it

By all means have a go! But did he ask you to pay him personally, or into a trade account? That's the crux of it.

Of course, if he claims it's personal, but you saw all this other stuff for sale, the IR and potentially Trading Standards would be interested. Thumbs Up

Does the seller show up as the last registered keeper on the v5?

If he does, then he can argue he is private. If he doesn't, then surely he has 'traded' the car on...

If so, go back and set a few of his other vehicles on fire!
Failing that, go round with few big mates and give him a good beating.
