He was actually within his rights to refuse to refund. Private sellers are not assumed to be experts, so it is sold as seen and even if the engine falls out 1 mile down the road, there is no legal comeback...unless you can PROVE the seller KNOWINGLY described the car incorrectly. But that's very hard, because they only have to say they didn't know. That is AA legal advice btw as something similar happened to me.

So chap, was the seller of this Discovery a business or a private individual? You are much more likely to get a refund from the former rather than the latter.
