Third row seats - Quick Question |
|
HI all,
Just a quick question.
I have a six year old daughter and my partner has a 5 year old son. When they get together they always insist that they sit to term their phrase "in the boot", the third row seats.
My question is do I still need to use their booster chairs etc? The seat belts don't cut across their necks, it sits across their chests as it should and to be honest the child seats don't sit on them properly.
Questioning as I don't want to fall foul of our boys in blue.
Thanks in advance.

The law just defines the requirement for a "rear seat" there is no other definition so my interpretation would be that the correct restraint is required.
Quote:In the Rear Seat
The child MUST use the correct restraint, where seat belts are fitted.
There are three exceptions where there is not a child seat available. In each case the child MUST use the adult belt instead. They are -
1) in a licensed taxi or private hire vehicle;
2) if the child is travelling on a short distance for reason of unexpected necessity;
3) if there are two occupied child restraints in the rear which prevent the fitment of a third. 21 year LR veteran > D2 GS 2003 > D3 S 2006 > D3 HSE 2009 > D4 HSE 2013 > D4 HSE 2015 > D5 HSE 2018 > DS HSE R-Dynamic P300e 2021

My thought is: why wouldn't you?
350 kids a year killed in the UK in cars with incorrectly or not actually fitted child seats.

My 4 year old always wants to sit in the rear, we put him on a booster. My only concern with him being in the rear is in the event of a rapid exit, as it would take longer to get him out as opposed to the middle row which has better access. If the seats fir them without boosters - why would you?
We had exactly the same issue with our old 944S2 a few years back ~ the rear seats fitted the kids perfectly!
Unfortunately the rules have to be simple to apply, so you'll need to use the designated boosters / child seats to remain legal.

the rear seats are still classed as full sized seats.
When our 7 year old and his mate goes in the back, they usually use booster seats. Not the big seats, just boosters. Bodsys Brake Bible

The child should have a car seat/booster cushion until they are above 135cm tall or 12 years old as per the link below -

At work the other week I stopped a Corsa, a 22 month old carried unrestrained on the rear seat. Both the driver and the mother had such a pop at me like I was the bad guy!

I see it all too often on the roads, kids half standing leaning between the front seats - I mean, come on, can the parents not figure out how fast their kids is going to go through the windscreen in a collision? Not making your kids wear a seat belt should come under the 'child abuse' umbrella IMHO.
My kids have both objected at some point to wearing one - I simply set off on the drive way to about 3-4 mph and slammed on - they of course fell off the seat - never argued with me since....simples!

I think you would need booster cushions at least to keep you legal. Also, even if there is not the issue of the seat belts around their necks, it will also give them a better view of the outside and also you you would have a better view of them in your mirror. They are also much easier to tuck out of the way when not required, so you would always have them in the car.
