Just been filling in various bits of paperwork relating to the accident and the ensuing chaos........
Oh well has to be done I suppose. Looking forward to seeing my pride and joy fully rebuilt and looking like it should do, will take at least two weeks but at least the small number of scratches that were present on her (bumpers mainly) will also have been fixed as a result! 2016 Discovery 4 Commercial

I'm glad it's working out OK for you and your truck will be restored to its former glory.
I often wonder why car insurance doesn't recompense the psychological damage an accident can inflict on the innocent party - stress, anxiety, and also all the hassle filling in forms and dealing with loads of 3rd parties. True. A friend of mine who is a psychologist has told me that I should be able to claim for the trauma and stress of the actual incident itself, she reckons the thing to do is to get my insurance company to approach the other one and see what they offer, if anything. 2016 Discovery 4 Commercial

I was involved in an accident many years ago, not my fault but hit head on by another driver. Long story short, driver was not insured and turned out to be drunk, car did not belong to him and my car was written off, mark 1 Capri Luckily I had reported neck pain which turned out to be whip lash and as such got a payout for personal injury via the motor insurance burea. My solicitor who handled all of this told me at the time if you are ever involved in an accident always report any injury or stress because if the other party is not insured and you are only third party yoy can always claim from the MIB. The good news is that I received confirmation this morning that everything has been given the go-ahead for the repairs to my D4 and it should hopefully be ready in a couple of weeks time.... 2016 Discovery 4 Commercial

Quite agree KingoftheSparks....nothing's an accident anymore, someone has to pay!!
Ironically it's the innocent ones that do, i.e having to pay higher premiums to pay for compensation!

Actually it is an accident if someone dies at the wheel (heart attack for example) and ploughs into you. I'm afraid you're on your own at that point.

Thats not quite right.
It all depends on the persons previous state of health. If the person had a history of heart attacks then there would be less chance of liability being in dispute.
However, should it be a young fit person who suffered the heart attack which resulted in the accident, and it could be shown that there was no previous indication of poor health then it may be hard to prove the accident was as a result of their negligence.
It would all be down to medical evidence.

Under the Road Traffic Act you just need to prove negligence.
