With the new changes to the highway code yes you will be deemed to be at fault.

Crazy, but that's the law.


I'm not sure that part is quite right. AFAIK the charge can only be claimed as a result of bodily injury (including fatal injury) caused by, or arising out of, the use of a motor vehicle on a road’. If the vehicle is parked up then it isn't the cause nor in use when someone runs into it
