Discotres, how many product returns have John Lewis kept for 3.5 years awaiting pick up. From your comments comparing services I assume there must be some you know of.
As a customer I would be amazed if a company kept something that long.
If something unforseen happened to the buyer then I would be very sorry to hear that, but I don't think a company is wrong to approach it this way in the absence of any information. Obviously a discount on a newer replacement would be helpful as a gesture of good will.
I would genuinely be interested in a poll based on a similar fictious scenario (so as not to involve any real members), just to see what people's expectations are.
