I've been towing my digger and dumpers around for about 15 years now , with the 110 before the D3 Thumbs Up never had a problem yet Thumbs Up max distance from base is only about 10 miles Thumbs Up

Yes, this is one of the exemptions I mentioned. The EU derogation was written for those who may have geographically separated business (eg farmers) as it was recognised that they would not be in the at risk group that tachos aim to address.

The hire & reward phrase is to have you by the short and curlies for doing anything that may be in connection with your business, even if you were not paid directly. People still get caught out by this by claiming the equipment is for their own use and nothing to do with business. They then get trapped by the taxman for incorrectly claiming tax relief / VAT rules on the very same equipment

If you have a demonstrably local business then the derogation may apply. 'VOSA' are pretty good at checking up on such things.

Yes most of you need a tacho unless tools for your work under 50km . Basically if you are moving house thats fine anything to do with business you need a tacho. And yes Vosa and customs do wait outside farm sales and auctions, builders merchants or any other place there is an easy guranteed knicking.

Hi there

The best source to answer your question would be VOSA or DVSA as they are now known as.

Having spent today on a road check with them, placed outside a breakers yard and picking off dubious Transits (along with other vans) and other vehicles towing and carrying vehicles for breaking or repair the law on what needs a tachograph is a mine field.

It is amazing how many should have a tachograph and don't.

We have spent a lot of time looking into this and it was such a grey area we in the end got advise from the road haulage association. The answer is there is no need for a Tacho if you are moving your own equipment, materials or product within a 50km radius of your registered base, ie: insurance address for the vehicle. Thumbs Up Thumbs Up

I don't think you need one anyway, you are exempt from EU law and come under domestic law (i.e UK) if

"vehicles or combinations of vehicles with a maximum permissible weight of 7.5 tonnes or less that are used for carrying work equipment for the driver"

Hire and Reward is where you get paid for transporting people or product, not takong your tools to be used on a job for which you get paid.

I don't believe the 50km rule applies to this either, so there is no limit on distance

The 50km only applies to certain combinations

5. Exemptions from EU law
Some types of vehicle are exempt from EU rules. This means that they come under GB Domestic rules in the UK.

The main types of vehicle that are exempt include:

vehicles that can’t go faster than 40 kilometres per hour, including vehicles that are restricted by a set speed limiter
emergency aid vehicles - vehicles used in the non-commercial transport of humanitarian aid for use in emergencies or rescue operations
breakdown vehicles - specialised breakdown vehicles working within a 100km of their base
vehicles undergoing road tests for technical development, repair or maintenance purposes, and new or rebuilt vehicles which have not yet been put into service
non-commercial vehicles under 7.5 tonnes - for example a person moving house or goods carried by a non-profit making group or registered charity
vehicles manufactured more than 25 years ago
vehicles with between 10 to 17 seats used exclusively for non-commercial passengers, eg minibuses used by voluntary and community groups
vehicles used by agricultural, horticultural, forestry, farming or fishery businesses for carrying goods within 100km of where the business is based
vehicles that are used to carry live animals between a farm and a market, or from a market to a slaughterhouse where the distance is less than 50km
vehicles that are used to carry animal waste or carcasses that are not intended for human consumption
educational vehicles, eg play buses and mobile libraries
vehicles or combinations of vehicles with a maximum permissible weight of 7.5 tonnes or less that are used for carrying work equipment for the driver
vehicles driven only on islands whose area does not exceed 2,300km2
vehicles with a maximum weight of 7.5 tonnes which use natural or liquefied gas or electricity as fuel and carry goods within 50km from their base
driving instruction or exams - vehicles used for driving instruction and examination. Includes instruction for renewal of Driver Certificate of Professional Competence (CPC)
circus vehicles - specialised vehicles transporting circus and funfair equipment
milk collection - vehicles used for collecting milk from farms or returning milk containers or milk products for animal feed to farms
any vehicle that was manufactured more than 25 years from the occasion on which it is being driven
any vehicle that is propelled by steam

Guessing there aren't too many people on here moving animal carcasses, and traveling circus.
General rule of thumb would be yes commercially unless 50km. Thumbs Up

50km doesn't only apply to domestic/private from what we were told. These are exemptions from driver hours

In Stu's case it is

So if the chap driving is using the kit, then it is OK. Which is what we did for a aeroplane starter unit
