My advise would be if you are unsure about your combination then check with a association or governing body. The rules are reviewed on a reasonably regular basis, RHA and others like them are there to advise and its to late when the blue lights are flashing behind you. Transit Custom LWB

So if the chap driving is using the kit, then it is OK. Which is what we did for a aeroplane starter unit

For "Hire or Reward" I think you should read "commercial purposes"
I know of several Land Rover and trailer combinations that have had to have tachos and they have been moving only their own equipment but as part of a commercoal operation.
Also check the plated weight of the trailer and what it can carry.
I guess the only way to judge it would be to find out the maximum gross train weight (can't remember what it is called now) allowable and go from there.
If it iss a grey area then play it safe as if it is grey then that means that there either no guidance or conflicting rules and if there are comflicting rules then you can get done with one of them.
It doesn't matter who own the vehicle, trailer or whatever is being carried, it's who is operating it that matters.

Be worth getting it in writing so you are in the clear in case you get stopped.
From my understanding the driver has to be involved in the use of the tools, you can't have a driver taking plant to a site and then going to the next site with more pant etc.

Just got this document from a colleague and it does look like the 50km rule applies to using your own tools as well.
I would be definitely get it in writing to be sure.

Stew, the above and your other comment is why I think you may need one. The EU rule itself states that you have to have one so the only exception to this is the UK derogation which is very specific. If you drive the vehicle and are the sole user of the plant and always remain within the 50km distance then you are operating in accordance with the derogation. If the plant is subsequently used by anyone else on site then the derogation no longer applies and you come under the main body of the rule.
The UK derogations are also underpinned by case law; effectively the interpretation of the UK derogation by the courts. The personal use bit is critical so if you are the only person who ever operates the plant on a job you are ok. If someone else from your team or indeed anyone else operates the plant whilst you eat your pasties then you may not be ok.

I think as i am really the only operator of the digger I think I should be ok , I wouldn't want to tow it more than 50 km because you know it's on the back , I'll will carry on as I am for now but I'll do some investigating -------------------------------------------------
if you cant hold on dont let go , it ill come in handy for something even if you never use it.

for the driver’s use in the course of his work.
These vehicles shall be used only within a 50 km
radius of the base of the undertaking and on the
condition that driving the vehicle does not constitute
the driver’s main activity.
This would apply to tradesmen such as electricians or
builders carrying tools or materials for their own use.

Exactly as we were told by RHA 50km rule applies. We have there print out laminated in the glove box of all our tow vehicles just incase. Transit Custom LWB
