Does this need a tacograph?

Brother's business use, trailer pulled by my parent's D3. Not sure of distance from base but it could be based in Cardiff and going to be used in London. My thoughts are it would need a tacho, thoughts from those in the know out there. Trailer & forklift 3.5 tonnes.

It's for his and his employees use to set up exhibition stands, he's not hiring it out. Thumbs Up

PS anyone know the max combined weight of a towing D4? I think the GVW is about 3.25 tonnes?

If the D3 belongs to your parents, is being driven by them and is not for commercial gain then I would say no tachometer.

If your brother is borrowing the D3 and the equipment is associated with his business then I would say yes to tachometer.

It is a weird area of regulation so interested in all opinions and experience.

It's the same with my digger and dumpers , I don't hire them out , there for our own contracts for my customers , so I believe that's ok Thumbs Up , I did look in to it a long time ago Thumbs Up

That's what's happening I think. Forklift is from his warehouse and D4 from my folks, probably hired the trailer.

Mine is part of my tools and is just under 3.5 tone .




If I were delivering it to another builder to hire with out one of my drivers then I think I would need one .

My conversation with Land Rover Legal department when I worked there was any use directly or indirectly for Hire or reward including your own business needed Tachograph if train weight over 3.5T and goods being carried. It is just an opinion at the time, & having said this it is a real minefield and DVSA wont offer any advise.

L319, that is my understanding too. There are a few exemptions (own leisure, horses and 50km rule for own use etc) but none that fit the scenario given by Stew.

It's a grey area I think Confused A vosa van followed me on Friday for 2 miles and I was waiting for him to stop me , digger boom was strapped to the right part of the trailer and all lights working plus my strobe light is always on when towing as the trailer is wider than the D3 , I was sweeting a bit Whistle but he didn't stop me Thumbs Up

I believe that stew is ok. There was a rule about distance from registered address also Stew's digger use is not hire or reward as it is his and is used as part of his contract. If he was collecting goods owned by someone else transporting them for a fee then he would. Thats my understanding anyway. Thumbs Up

If this wasnt the case plod would be sitting outside every builders merchant giving tickets out on an hourly basis. Thumbs Up
