Section 75 applies to Credit Cards, but you can still apply for a Chargeback for Debit Card transactions where the goods demonstrably don't meet the description.

It's not a legal process, it's a commercial terms process so you may need to be a bit more proactive to get the desired outcome, but it's well worth giving it a go. I know it's not considered "kind" to say no these days, but no. Just no, ok? And if it's not ok, still no.

It is a long time since I have had a good look at tyre ages.
Last time I looked (a few years back) new tyres should not be more than 2 years old and should be replaced due to age at about 7 years.
Argument being that the 2 years new would give a reasonable life span of 5 years use, ignoring tyre wear.
Just had a quick look and 'new' tyres can be up to 5 years past the manufacturing DOT date. (Based on a German study). Age limit is now 10 years before replacing tyre due to age which would give minimum 5 years service life.
Now I wonder if the 10 year is due to limit on HGV tyres? Or has rubber technology improved?
Personally when ordering new tyres I would make it a condition that tyre DOT age less then 2 years.

By their own draconian t’s and c’s they claim a new tyre can be up to three years old. So these are not new by their own words.
There are just ignoring every email or just stating that are looking into it and fobbing me off. Apparently they have been looking into it for two weeks now.
The same t’s and c’s state they will charge me £25 per tyre to have them sent back…
Clearly sharks…. I am only putting this out there so no other forum members get ripped off!

Don’t intend to rub it in but if you were part of EU returns are on behalf of the seller, extra charges aren’t allowed.
FWIW, when buying the latest model of tires you tend to get brand new ones. I purchased Nokian Hakkapeliitta 10s to our Volvo and time of manufacture was week 23 of 2021. Similarly when buying the Pirelli AT+ a few years ago they were basically fresh from the factory.

These are Pirelli Zero all seasons W rated so proper tyres… just old and second hand!

If you have ordered new tyres and they state in t and c a new tyre can be up to 3 years old then other firms saying new tyres can be up to 5 years old is irrelevant.
Now am not sure of exact wording but a letter recorded delivery AND email of notice to take action prior to small courts claim on the grounds by their definitions they were not new tyres might get them to take notice. Especially if you were prepare to follow it through. Not a guaranteed result but might be worth a try.

If it’s really an Andorran company they might take the view that a ruling from a uk small claims court cannot be enforced in their jurisdiction.

The secondary school announcing on Facebook at 2340hrs last night that first and second years won’t be at school today because of staffing shortages due to Covid. A bit late for that decision.
I don’t use Facebook, my older daughter messaged me as I was just off to bed otherwise the boy would have been waiting for his bus at 8am.

It is an MOT failure or roadside prohibition to have a tyre over 10 years old on any steered axle of an HGV or single wheel of a minibus. We fit our own and are supplied directly from the manufacturer (currently Goodyear) so I don't have this issue, but there are probably some dodgy operators running older tyres. 2004 Disco 3 HSE TDV6

Right, took the dog - small Yorkie, to the Vets for the annual jags. They told me she needs a scale and polish, nothing desperate, no teeth extracted as far as they can tell, just routine.
They want £200 for it. Okay says I. Got her booked in for the start of December.
Got home and was putting away her vaccination record and noticed a bill, the same Vet did them in 2018 and charged £115.
Also booked the boys Halls of Residence yesterday for his final year same place, same room, this year £5,450, next year, well from September 2022 onwards, it has gone up £375! They are taking £250 deposit from me just now, last year it was £1 for some reason.
Is it me or are people using COVID as an excuse to shove their prices right up the jacksie.
