Ive had a angry phonecall from the seller
he has had his ebay account suspended !

Iv etold him that trading standards are investigating and i will sue him for it and he got very shirty telling me how he would defend it
i susupect he is an old hand at this

i will sue him as s matter of prnciple i will win and we will tak efrom there

i have even offered to sell it on ebay 'mileage unknown ' and for him to pay me whatever differance is between selling price and what i paid and he told me he wouldnt even do that

i am really trying to be fair and i cant understand his attitude

if i mess up in business i move heaven and earth to make things right regardless of cost sadly not everyone like this

Manheims catalogue for the sale of your car at Bristol on 1st December 2009 (Details are: Reg, EU57 UHR, first registered 07/12/07) stated that the car had done 155k miles at that time.

I suggest you get on to a few on-line car valuation sites and gete a value, as of now for your car with 155k miles, 95k miles, plus I would suggest 185k miles & 200k miles. The last two being the milage which it might reasonably expected to have covered by now.

Part of the damages which you should be claiming is the difference between the value of your car with 95k miles on it, and whatever the true milage is.

Your claim should include a very major service, this needs to be done as the milage is so uncertain.

In the first instance seek the help of people such as AA or RAC if you are a member, your insurers (home or car) as they may cover litigation.

Publicity is always a good weapon, but be sure of your facts. gather as much evidence as you can starting with a copy of the Manheims catalogue for their Bristol sale on 1st December 2009 - ask them to give you details of the purchaser, or to send them to the Police & Trading Standards.

You should also think about taking Ebay to court. I, amongst others, alerted ebay to the fact that the seller was selling a car that had incorrect mileage. I would assume - personally - that he was knowingly selling this car with a false mileage given that other forum members informed him of this fact. Ebay will be able to provide the correspondance and I'd recommend you request this from them - through legal chains, no doubt - as it will support your claim.

Because ebay were alerted to this sellers activity, I believe they are part-liable.

The problem with E bay is they are os hard to contact
im impressed they have closed the sellers account
believe me i know he will reappear but given he sells caravans mainly ( and clocked cars ) in powys he will be easy to find and i will report him again

Ive tried to talk to him and he simply says its not his fault
my solicitor and tradinf standards say differant

I am going to get it revalued wihich is hard to do but will start at my main dealer
they are also going to giveme a price and undertake a full service which will cost me a lot of money

I do feel stupid as i wished i had searched the reg on here first but i tht id checked it all properly and ive psoken to landrover and th emileage records they have ties up with the current mileage

I do believe now this seller new as why would you buy a disco and then sell 2 weeks later
he claims that he bought it for aholiday to tow a caravan but given he owns a range rover and BMW 5 series i doubt this is true

I have worked 7 days a week for 6 months to buy this car for cash and i feel gutted i hav ebeen had over

it wont end her and i will sue him and my sloicotr is 100% certain i will win
it will cost this seller a lot of money and we will recover the money through the legal channels

for now i will try and reapir any faults and carry on driving

we have stripped the handbrake to see why it didnt work properlty and somoene has removed all shoes ect so thats first job

Can anyone recomend a good independent Landrover Service agent in the North west as the ones i know wont touch D3

I'm puzzled that Land Rover's records back up the mileage. Before youn run up too many bills, do some more research on the mileage with Highways Agency and double check engine, chassis and Reg numbers with them and Land Rover

If the parking brake shoes had been removed, surely the vehicle would be classed as unroadworthy. This is more information to support your case against the seller.

I'm sure that I'm correct in saying that if you sell an unroadworthy vehicle without clarifying the faults (even as a private sale) the buyer is entitled to a full refund. This happened to a friend of mine who sold his 13 year old fiesta for £350 a few years ago, the buyer then took it for an MOT and it failed, the buyer then returned with a couple of mates and quoted some legal stuff demanding a refund. In fairness I think the law might not have been that relevant to the refund, more the 3 guys threatening to beat the carp out my mate was what peruaded him !! He did however sell in good faith - he knows nothing about cars, I think filling the washer bottle would challenge his tech skills!! Laughing Laughing

ive chked the numbers they all tally up
its also got a few tell tale signs its had radios ect fitted allthough they have done a good job repairing the dash and the dents in the body

to be honest i will use my company solicotr i dont actually care now about the money ive been stiched up and i will win and all my costs
im nit ointersetedin hios sob stories that he has no money i will win and i will get my money by any megal mean pssible
i am sick of unscrupulos traders who dont care

Carl, get on to the auctions in Bristol that listed this car with the mega mileage and see if the crown estates disposal department have any records. I'd hate for this to be an auction catalogue foul-up.
